Palsgraf v. Long Island Rail is one of the most influential court cases of the 1th century. The case tested the rules of negligence. The dissenting, Justice Andrews questioned, that upon the facts presented may the plaintiff recover the damages she suffered? The dissenting side concluded that the appellant in his brief did state "it cannot be denied that the explosion was the direct cause of the plaintiff injuries." Therefore, the explosion was the factor that ended in the result. There was a natural and continuous sequence. That the explosion as in this case, needed no great foresight to predict that it would result in the injury of a person or persons on the platform.

Justice Cardozo then stated that the plaintiff could not recover against the railroad because the railroads employee's didn't intend to harm anyone. Cardozo reasoned the "risk imports relation it is the risk to another or to others with in the range of apprehension." "What we do mean by the word "Proximate" is that, because of convenience, of public policy, of a rough sense of justice the law arbitrarily declines to trace a series of events beyond a certain point"(www.courts.stateny.com)


In my opinion, I feel that the appellant side of the appeals court was right. Justice Cardozo made a valiant point. The workers at the railroad station had no intent to harm any person at the station that day. The guards were doing there job and while saving the mans life had no idea his package had fireworks. If they did not help him he probably would've fell on the tracks and died.


At the same time though you could say they were negligent in the way they checked the package. Stepping back and looking at the time period it took place in. It wasn't one in which people couldn't trust others and terrorism was not known of at the time. I'm sure there were many people that day who were carrying packages that closely resembled that of which the man who had the fireworks was carrying.


After giving points supporting both sides I feel there is overwhelming evidence for the appellate side. For instance say the man dropped the package trying to jump on the train himself with out the guards help. The same injuries would have happened. How then would you be able to blame the railroad?


A similar situation would be if an employee at a company stuck a gun in and shot his fellow workers. Is the company going to be charged with murder? NO. The man would be brought up on the charges and prosecuted to the full extent of the law. Not many people would believe it's the companies' fault.


Every day there are unintended injuries due to accidents. People don't sue highway departments when they get into a car accident even though it took place on the highway. They sue the driver. If Palsgraff wanted to get money from anyone I feel she should've sued the man with the package. It was his negligence that caused this accident. The Railroad was at no fault and although it wasn't a landslide decision it was overturned and ruled in the defendants favor. I feel the court of Appeals of New York served justice right.

"When you durst do it, then you were a man; and, to be more than you were, be so much more the man,". I felt pity when Macbeth begins to show signs of stress , for he speaks few words in his replies to Banquo; and when he is alone, the strain shows very clearly. He notices a bizarre spectacle.

However, this is not what his eyes reveal, when grabbing for the dagger,

The dagger is a hallucination, which reveals that Macbeth is in great emotional stress and that his mind is beginning to collapse.


Although he is first alarmed by the dagger that his imagination has created, he seems to enjoy the horror of the moment. The last lines of the scene could even show a grim humour


"The bell invites. Hear it not Duncan; for it is a knell that summons thee to heaven, or to hell." He mutters to himself, when his wife signals him that the guards are not in patrol in the Kings Chamber.


Before the murder, this incident shows evil and dark intentions of murder and greed. In the later part, however, shows feelings of deep guilt and regret. Coming back to his wife, who greets him with relief and pride "My husband.", Macbeth slowly awakens from the nightmare he has been living in and realises what a terrible crime he has committed. He speaks of the voices he heard

resonance imaging (MRI) are two forms of brain scans used to generate pictures of the

energy to get different responses from different types of tissues inside the brain to form


images. Positron emission tomography (PET scan) and magnetic resonance spectroscopy

the pre-frontal cortex, is responsible for planning, deciding, one's personality,


temperament, speech, and control of the body's voluntary muscles(Zimbardo 66). The


cerebellum located near the back of the brain is coordinates movement, controls posture,


and maintains equilibrium. The cerebellum is also involved in learning, specifically classical


conditioning, which allows us to give responses to new cues, like when a bell rings we


know it means something, rather it be time for the next class in high school or it's time for


church to begin(6).


But some instances of brain impairment caused by alcoholism are reversible by


abstaining from drinking. Recovering alcoholics begin to regain problem-solving abilities,


short term memory, brain volume, and their ability to pay attention after several months to


a year of not drinking. The brain itself has the power to change the patterns and pathways


of brain activity. Scientists have seen the brain send information away from those regions


of the brain that have been damaged due to alcohol through alternate brain systems with


the help of brain scanning, in recovering alcoholics. Pfefferbaum and colleagues examined


the brain activity of cognitively impaired alcoholic participants during a series of tests


designed to assess cognitive function. The results of the test concluded that the brains' of


the alcoholic participants would use different nerve systems than, the control,


non-alcoholic participants to complete the tasks equally well. This finding is especially


uplifting for the young drinkers found in college because their brains are still creating


nerve-cell networks which send the information out from the brain to the rest of the

For all that scientists know about the brain and alcohol they are not sure how cognition


effects alcohol treatment. That is they know how alcohol effects cognition but they do not


know how the effects of alcohol apply to curing alcoholism. Cognitively impaired patients


may not have the means to understand the therapy and might not use strategies presented


to them to cure alcoholism. Another possibility is that cognitive functioning may not


influence alcoholism but it may have an effect on something else that could help stop


alcoholism. A few examples include getting a patient to focus on the importance of


exercising and nutrition, this may cause a recovering alcoholic to view alcohol as toxic to


their bodies. One last view on cognition's effect on recovery is that a patient wait after


the first weeks of being clean to try any therapy because cognitive impairment is usually


the worse in this period of time (Gordis 15-16).

particular recovering from dependency. I also found out a lot about the realm of


psychology and how all the disciplines interact in the "real world." I say the "real world"


because I have been sheltered from so much, but alcoholism is one of the few social ills I

link the old school theories of Freud with the technology of today, which also gives a lot


of meaning to what we do in class, and lets me know that this is information I am going to

These two authors want to inform their readers that their countries are much more then what people generalize them to be.


I have never been to the Caribbean and I will not lie when I say this, but I followed along with the generalizations. As I stated in the introduction, "…sandy beaches, tropical drinks, and the sound of the ocean in the background" is the picture I get when I think of the Caribbean. Now that I have read works from citizens of Caribbean countries, I am now informed of how the citizens of Antigua and Jamaica really feel about tourists' stereotypes and I look at these countries in a whole new light. From the first chapter of Kincaid's essay she goes on a rant about how her people drive around very expensive Japanese cars, but fuel them with the wrong type of gas, which in turn, ruins the car. Also, that their houses are worth less than what the car is actually worth. This is how these people have to live, but the tourists do not really understand why. She also talks about the people who have lived in Antigua all their life, and how their ancestors lived there. "The people in Antigua now, the people who really think of themselves as Antiguans are the descendants of those noble and exalted people, the slaves.", (80-81) and even though some people today do not like living in Antigua, the true citizens of the country and true Antiguans. On a different view of the same subject, Mutabaruka writes about generalizations, not tourism, but the same point gets across to the reader after he has written, "dis poem will not change things/ dis poem need to be changed/ dis poem is a rebirth of a people" (). He writes these words to show the reader that after someone has been informed, they can read the poem from a different point-of-view. I believe that these three examples justify completely with Kincaid's strategy, which I think is inform the reader and change their perspective. After that has been done, the reader can feel what the author is writing and not just pass over it like an unimportant piece of information.


Jamaica Kincaid and Mutabaruka just want their stories to be told strait. They want the generalizations to stop so that their readers are able to fully understand the words they have written. If every single tourist were like the one in Kincaid's essay, to travel to Antigua for the climate and not to learn more about the culture, I would write an essay about the "ugly tourists" also. And if all people were as ignorant as Mutabaruka writes them to be in his poem, I would also write a poem about all of the ignorant people I come across. These stereotypes are never going to come to an end, but if they were never there in the first place, this poem and essay would never have been written. As for the readers, we are now all informed as to how the people of these countries actually feel about tourism. Even though it may be a small percent, these authors would be happy to know that all tourists are not like the ones they have described, and that some people want to learn more about their countries. If I were Kincaid or Mutabaruka, I would be content just knowing that somebody out in this world knows how I feel, and would stop generalizing and try to change the way they looked at my country.

reign, Rivera halted the strife that had engulfed Spain the previous decade.


However in March10, Rivera suddenly died. Bolin states that Rivera's "mild


and efficient dictatorship would have saved the Monarchy and avoided the armed strife


that broke out in 16" (Bolin 167, ). So Bolin believes that Rivera could have saved


Spain from civil war and Franco's dictatorship. After his death, Rivera's successors tried


to highlight his mistakes and put the blame on the King. The following succession of


leaders attempted to bury Rivera and his work in the past. Bolin states that "there was no


attempt to continue the work that had brought Spain to almost unprecedented heights of


prosperity and internal peace" (Bolin 167, 10). The new leadership of the government


could have invested in Rivera's enterprises, but through selfishness and egotism failed to


advance Spain's position of welfare.


Another figure that Bolin contends, whose death led to the Spanish Revolution


was Calvo Sotelo. Sotelo occupied to position of minister of finance under Rivera and


was very proficient in economic and administrative procedures. He was able to forge


plans that helped Spain through the world-wide depression and aided the country in


developing ordinances. Bolin states that he "was as much at ease when balancing the


budget as when drafting municipal and provincial statutes comparable to the best in any


land" (Bolin 167, 141). This illustrates the importance of Sotelo in regards to the


Spanish government.


But Sotelo eventually became leader of the Right-wing opposition in the Spanish


Parliment. He enjoyed the privilege to attend all meetings and participate vigorously in


the matters of the state (Bolin 167, 141). Sotelo was a very important and critical figure


to the country and because of his influences and his devotion to the Right, he was


threatening to his opposition. Therefore Sotelo was kidnapped and murdered. Sotelo was


taken from his apartment at 00 a.m. on July 1, 16. Four men that identified


themselves as members if the Civil Guard, accompanied him from his apartment. The


men put him in a van and took their seats alongside him. A gunman then fired two


point-blank shots to Sotelo's neck and he was killed instantly (Bolin 167, 1-). The


Republican government tried the usual cover-up but there were too many witnesses


(Bolin 167, ). They had eliminated a key figure of opposition to their cause. Thus


with the deaths of two prominent figures of Spanish constitutional government, the


Franco's movement had separated key components of resistance.


Stanley Payne argues that the weakened state of the middle class along with


divisions formed within the Republican government were the prime causes that initiated


the Spanish Civil War. In his book The Spanish Revolution, Payne argues that during the


months leading to the revolution the Spanish middle classes were numb to the events


unfolding within the country. He claims that even though the economy was in a


downward spiral, the divisions of middle class leadership and numerous factions within


the political realm could offer no viable response to the revolution (Payne 170, 16). In


a state of weakened government, a military coup is simplified.


Payne points out that "revolutionaries were actually hoping to provoke the Army


to revolt so as to force it into an indefensible role in which its antileftist elements might


be destroyed, leaving the middle classes without protection and opening the way to a


leftist takeover" (Payne 170, 16). This premise accounts for the fact that the


revolutionaries were presuming that the divisions of government would rely on the army


to protect the symmetry of the nation, but the leftist knew they would sway the army to


their side.


Payne states that "the left Republican leaders soon sank into almost absolute


paralysis" (Payne 170, 1). He claims that if the Republican leaders had made an


effort to uphold the constitution and maintain the integrity of the state that the revolution


might not have occurred. This was because only half of the army had joined in the


revolt. Most of the Nay, Air Force, and police force had remained faithful (Payne 170,


1). So if the Republicans had acted swiftly and astutely, the entire course of Spanish


history would have been altered.

I always knew that returning to school was in my future, but struggled with when to return and which degree I wanted to pursue. The poem First Love written by John Clare is a free verse poem whereas, Shall I compare thee… written by William Shakespeare is a sonnet where it is made up of three quatrains and a rhyming couplet at the end. The two poems share a similar theme about love where both writers talk about love with a beautiful woman. The poem is about a young man who falls in love with a beautiful girl and starts talking about his first love by describing how he felt and what he thought of her and how she responds to him. John Clare describes the physical impact of first love, 'Struck before that hour… face turned pale as deadly pale… my legs refused to walk away.' Clare describes a state of powerless caused by the theft of his heart by the girl, 'stole my heart away complete.' Senses are described to be in turmoil when it is as if he is blinded by love, seemed midnight at noonday… I could not see a single thing.' He then goes and says that things will never be the same again and he conveys this by describing his heart as if it is an independent entity which has left home and now belongs elsewhere, 'my heart has left its dwelling-place and can return no more.' He is totally obsessed with her and describes her beauty, 'her face it bloomed like a sweet flower.' But he is too shy to approach her, 'and then my blood rushed to my face and took my sight away.' How does his love react? She seems to respond positively, 'she seemed to hear my silent voice and love's appeal to know… I never saw so sweet a face as that I stood before.


But in Shall I compare thee… its more about comparison rather than descriptive feelings. The poem is structured into three quatrains and a rhyming couplet at the end. Each quatrain features four lines and each line has ten syllables so this too also balances the poem out and gives a nice flow. Quatrain one presents a question, 'Shall I compare thee to a summers day?' comparing the girl to a nice summer day. The answer in the same quatrain is that she is more lovely and more temperate.' Quatrain two continues the comparison between a summer's day and the lady, to the detriment of the summer's day. Quatrain three announces a turning point with the word "But", and describes her superiority over summer and time, 'But thy eternall sommer shall not fade…when in eternall lines to time thou grow'st.' In the rhyming couplet, it is said that she will be realised and would be seen "immortalised", 'so long as men can breath or eyes can see, so long lives this, and this gives life to thee.'


As both are poems, usually there are rhymes and rhythms to make it an artful piece of work. In First Love, it is rhymed like "abab", for example;


a) 'I ne'er was struck before that hour,


b) With love so sudden and so Sweet,


a) Her face bloomed like a sweet flower


b) And stole my heart away complete.'


The pace of the poem sounds mellow and quite fast as each sentences is short and as well as the words which too would be pronounced quicker as there are only eight syllables in each sentence. The probable reason why the poet has done it this way making it a fast pace flowing poem is because the man is describing his feelings about this beautiful girl, where the poem is related to his heart, which is beating fast as he is seeing his first love and usually that first love tend to be a sensational feeling as he has never experienced it before. So in practice as he sees this girl and describing what he sees and feels, it would be like a rush of adrenaline and out of control. The pace of the poem would be similar to the pace of the heart.


In Shall I compare thee… there is a rhythm as well like "abab", for example;

b) Thou art more lovely and more temperate


a) Rough windes do shake the darling buds of Maie,


b) And Sommers lease hath all too short a date


The pace of the poem sounds slow and there are ten syllables in each sentence and there are some long words. The probable reason why the poet has done it this way because the poet probably wants the readers or listeners to understand what he is trying to say and so the pace of the poem would be slow making it last longer and thus making the readers/ listeners imagine the images the poet want to them to picture in their mind.


Imagery has been used to express themes in poems and so descriptions are needed. In First Love, there is a simile, 'Her face bloomed like a sweet flower' which since this poem is about a one man first love, the poet would like the reader/ listener to understand the mans feelings as to why he likes the girl by describing her like a sweet flower and this in turn helps to acknowledge the reasoning for this. Alliteration can be found as well like 'so sudden and so sweet' and 'saw so sweet', which gives a positive note as 'sweet' is a positive word. The poet wanted love to be good thing and so used 'With love so sudden and so sweet' to create a desirable effect that love is a great thing to have.


In Shall I compare thee…. metaphors are used like 'the eye of heaven', which is the metaphor of the sun. 'His gold complexion' where the sun is personified. That means when the sun comes the clouds go and block the sun saying that the sun will not be shining all the time as for the girl she will be shining. And 'not shall death bring…' where death is personified as if about to claim her. 'Shade' suggests the opposite of the sun and means ghost or soul after death. The choice of words used like, 'temperate' (moderate; restrained; of even temper) and 'darling' (beloved; lovable) helps reader understand the poem as a whole. With all the points accounted for, the poet in First Love is suggesting that love is a wondrous feeling and can be positive but once you become obsessive about it then it can create a devastating effect on the subject and brings disappointment towards the end and find setbacks. It happened before to the poet when he wanted to marry the daughter of a wealthy farmer but he could not due to his background and this disappointment made a lasting impression. The devices/ language is used effectively and the poet got the ideas across to the reader very well, as they are easy to understand and was made simpler. Words with two or less syllables were used and the devices used were simple and thus making the reader to understand the views and concept a lot quicker. I agree with the poem where first love can be a truly amazing feeling but once you have fallen into the obsessive stage then there is no way back and you will be stuck there and depression will come which happened to John Clare when he could not marry the girl he loved and so disappointment came and depression.


The poet in Shall I compare thee…. tries to say that time is a cruel thing and tries to defeat it by making the poem sound to last long. The poet is also saying that love is immortality and that time can be defeated. She will be immortalised in the lines of the poem, which will still be read long after she dies. With love, it can last forever. The devices/ language used is effective as it helps to create an easy image. Metaphors and personification helps to create images and made the poem more understandable. My response to this poem is that I agree that time can be defeated as it can never match love. Love has been around for years and does not seem to stop. With time progressing, so will love. But I believe that love and time is needed otherwise it would not make the world it is currently is. Without time there would not be love, and without love there would not be any progression.

The socialization process is different from one person to another. It is related not only with peoples education , but also with the environment in which peoples grown up.
